ACTîVUS™ Terms and Conditions

By accessing this website, booking services, purchasing any product or membership, or participating in any ACTîVUS™ program (in-person or online), you agree to these Terms & Conditions.
1) Use of Website
You agree to use this site for lawful purposes only and not to interfere with site security, access restricted areas, scrape content, or attempt unauthorized access to any systems, accounts, or data. We may suspend or terminate access for violations.
2) Eligibility
You must be at least 18 years old (or have a parent/guardian’s consent) to purchase services or create an account. You are responsible for ensuring the accuracy of the information you provide.
3) Services, Scheduling, and Changes
ACTîVUS™ may modify services, trainers, class schedules, session availability, pricing, and policies at any time. We will provide reasonable notice when practical; continued use constitutes acceptance of updates.
4) Payments, Memberships, and Sales Policy
All purchases are subject to verification and approval. All sales are final unless otherwise stated in writing at the time of purchase. Memberships, class packs, sessions, and digital products are non-refundable and non-transferable unless a specific written exception applies.
5) Cancellation Policy
For recurring memberships, cancellations must be submitted in writing before the next billing date (email or approved cancellation method). If canceled after the billing date, access continues through the end of the paid cycle and no refund is issued. Some membership types may include a contract term; early cancellation may result in a fee equal to 50% of the remaining balance where applicable and disclosed at purchase.
6) No-Show / Late Cancel Policy
Class and appointment spots are limited. Missed sessions, late cancellations, or failure to attend may be treated as used sessions and may be subject to fees or forfeiture, as disclosed during booking and/or in your membership terms.
7) Health Disclaimer & Assumption of Risk
Exercise carries inherent risk, including serious injury or death. You agree to consult a physician before participating and confirm you are physically able to train. By participating, you voluntarily assume all risks associated with fitness and training activities.
8) Waiver & Limitation of Liability
To the fullest extent permitted by law, ACTîVUS™, its owners, staff, contractors, and affiliates are not liable for any injury, loss, claim, or damages arising from your use of our facilities, services, website, or content, including participation in classes, personal training, or events. Where required, additional waivers may apply and must be accepted prior to participation.
9) Facility Rules & Personal Property
You agree to follow all posted rules, staff instructions, and safety guidelines. ACTîVUS™ is not responsible for lost, stolen, or damaged personal property.
10) Media Release (Footage & Photography)
ACTîVUS™ may capture general photo/video content in the facility for marketing and brand purposes. We will not post before-and-after photos or individually identifiable content without your express consent. You acknowledge you may appear incidentally in group footage; participation grants ACTîVUS™ limited permission to use such incidental footage consistent with this policy.
11) Intellectual Property
All site content, branding, logos, slogans, class names, training systems, videos, and written programs are the exclusive property of ACTîVUS™ and protected by intellectual property laws. You may not copy, distribute, sell, or reproduce any content without written permission.
12) Third-Party Services
We may use third-party platforms (e.g., MindBody, payment processors, analytics tools). ACTîVUS™ is not responsible for outages or issues caused by third-party services, and your use of those services may also be governed by their terms and policies.
13) Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we collect and use information.
14) Dispute Resolution, Governing Law, and Venue
These Terms are governed by the laws of the State of North Carolina. Any legal action must be brought in Guilford County, North Carolina, unless otherwise required by law.
15) Updates to Terms
We may update these Terms at any time by posting the revised version on this site. Continued use after changes means you accept the updated Terms.

ACTîVUS™ Refund, Return & Cancellation Policy

1) Refunds
ACTîVUS™ offers a limited refund window of 72 hours from the original purchase time for eligible purchases only if unused. “Unused” means no classes attended, no sessions completed, no check-ins, and no digital program/content accessed or downloaded (if applicable). After 72 hours, all sales are final and no refunds will be issued for unused sessions, missed classes, no-shows, or failure to attend.
2) Returns
Retail returns (if approved) must be requested within 72 hours of purchase and items must be unused, unwashed, and in original condition with original packaging/tags where applicable. ACTîVUS™ reserves the right to deny any return that does not meet these conditions. Digital products are non-returnable once accessed or delivered.
3) Membership Cancellations
Recurring memberships must be canceled in writing prior to the next billing date (email or an approved cancellation method). If a cancellation is submitted after the billing date, the membership remains active through the end of the paid cycle and no refund is issued. Certain membership types may include contract terms—early cancellation may result in a charge equal to 50% of the remaining balance, where applicable and disclosed at purchase.
4) Chargebacks & Payment Disputes
Customers agree to contact ACTîVUS™ first to resolve billing issues before initiating a chargeback. Unauthorized chargebacks may result in account suspension and/or collections for amounts owed, where permitted by law.
5) How to Request (Refund/Return/Cancellation)
Submit requests to Quincy@GetActivus.com with your full name, purchase date, receipt, and reason for request. Approved refunds (if any) are issued to the original payment method per processor timelines.
